Terms of Service
These terms govern access to the AiraNote Windows application, website, accounts, subscriptions, and related services. Please read them before creating an account, downloading the application, or purchasing a plan.
1. About AiraNote and these terms
AiraNote is a product owned and operated by Aimee Digital Marketing, a business carried on by a sole trader in the United Kingdom. The sole trader trading as Aimee Digital Marketing is the contracting seller, software licensor, and service provider. In these terms, "AiraNote", "Aimee Digital Marketing", "we", "us", and "our" refer to that operator as the context requires.
Our business and correspondence address is Aimee Digital Marketing, Thomas Hardy Mews, Thrale Road, London SW16 1DQ, United Kingdom. Contact support@airanote.com. The sole trader's legal identity is provided on applicable payment receipts and official transaction records.
By creating an account, using AiraNote, or purchasing a subscription, you agree to these terms, the Privacy Notice, Refund and Cancellation Policy, and Acceptable Use Policy. If you purchase for an organisation, you confirm that you have authority to bind it.
Nothing in these terms excludes rights that cannot lawfully be excluded, including mandatory consumer rights.
The checkout description and order confirmation form part of the contract. If documents genuinely conflict, mandatory law applies first; the checkout or order confirmation controls the selected plan, price, billing interval, and renewal date; these terms apply next; and the referenced policies apply to their specific subjects. The Privacy Notice governs personal-information handling. A more specific provision controls only the subject of the conflict.
2. The service
AiraNote provides Windows speech-to-text, dictation, file transcription, transcript management, personal dictionary tools, and account-based licensing. Features, supported languages, system requirements, and plan limits are described in the application or on the website.
Speech recognition is probabilistic. Output may contain omissions, substitutions, formatting errors, or incorrect names and numbers. You must review text before relying on, sending, filing, publishing, or using it to make a legal, medical, financial, immigration, employment, safety, or other important decision. AiraNote is a productivity tool and does not provide professional advice.
3. Eligibility and accounts
- You must be at least 18 and legally able to enter a contract.
- You must provide accurate account and billing information.
- You are responsible for protecting your credentials and devices.
- You must promptly report suspected unauthorised access.
- Accounts are personal unless an organisation plan expressly allows shared administration.
We may require reasonable verification to prevent fraud, duplicate accounts, payment abuse, or circumvention of plan limits.
4. Software licence
While your account is permitted to use AiraNote, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the application on the number of devices allowed by your plan. The software is licensed, not sold.
You may not sell, rent, sublicense, redistribute, publicly host, copy except for a reasonable backup, remove ownership notices, bypass activation or usage controls, or reverse engineer the software except to the limited extent such restriction is prohibited by law.
5. Free plan and fair use
The Free plan is intended for personal, non-commercial evaluation and light personal use. It is limited to one Free account per natural person. Creating aliases, using multiple email addresses, rotating devices, sharing accounts, scripting sign-ups, resetting identifiers, or otherwise attempting to obtain additional free allowance is prohibited.
Free access does not create a right to any particular feature or permanent allowance. We may change or withdraw Free-plan features with reasonable notice where practical. We will not automatically move a Free user to a paid plan or charge them without express agreement.
Professional, organisational, client-facing, or revenue-generating use requires an appropriate paid plan.
6. Paid plans, renewal, and price changes
Personal and Professional plans renew automatically monthly or annually until cancelled. The billing interval, total price, taxes where applicable, and renewal date are shown before payment and in the Stripe receipt. You authorise recurring charges using your selected payment method.
You may cancel at any time. Cancellation normally takes effect at the end of the paid billing period, after which paid features stop. Cancellation prevents future renewal; it does not automatically create a refund for a period already started. Refund rights are set out in the Refund and Cancellation Policy.
Deleting the application, ceasing use, allowing a device to become inactive, or deleting an account without first cancelling the subscription does not cancel recurring billing. A cancellation is effective when it is recorded by the billing portal or acknowledged by support. Completed billing periods are not reopened merely because the service was unused or a cancellation request was made later.
We may change future prices by giving reasonable advance notice. A price change will not be applied retrospectively to an already-paid period.
7. Your recordings, text, and permissions
You retain ownership of recordings, transcripts, dictionary entries, and other content you create. You are responsible for having a lawful basis and any necessary permission to record, transcribe, store, or use another person's speech or personal information.
You must not use AiraNote to intercept private communications, conduct covert or unlawful surveillance, infringe confidentiality, copyright, or data protection rights, or create unlawful content.
8. Usage limits and metering
Plans include stated word, file transcription, device, duration, and feature limits. Usage records generated by the service are the primary record for applying those limits, subject to correction where a verified technical error occurred. Unused allowance does not roll over unless a plan expressly says otherwise.
Attempts to manipulate word counts, replay offline leases, alter the application, interfere with metering, or misrepresent the source of usage are material breaches of these terms.
9. Updates and availability
We may provide security fixes, compatibility updates, and feature changes. Some updates may be required to continue using online licensing or paid features. We do not promise uninterrupted availability, but we will use reasonable care and skill in providing the service and will not reduce statutory rights.
You are responsible for a compatible Windows computer, microphone, internet access where licensing requires it, backups, and installing important operating-system and application updates.
10. Security and prohibited conduct
You must follow the Acceptable Use Policy. In particular, you may not attack, probe, overload, scrape, tamper with, or gain unauthorised access to the service, other accounts, payment flow, source code, usage controls, or infrastructure.
11. Suspension and termination
We may restrict or suspend an account where reasonably necessary to investigate fraud, security threats, chargeback abuse, unlawful activity, non-payment, duplicate Free accounts, or a material breach. Where appropriate, we will explain the reason and provide a chance to resolve it. We may terminate immediately where delay would create legal, security, or material operational risk.
Suspension or termination for breach does not entitle the user to a refund for value already received, except where required by law. Terms intended to survive termination, including intellectual property, accrued payment, liability, and dispute provisions, remain effective.
12. AiraNote intellectual property
AiraNote, its software, branding, interface, documentation, and service technology are owned by Aimee Digital Marketing or its licensors. No rights are granted except the limited licence expressly stated in these terms. Feedback may be used to improve the service without payment or attribution, but we will not claim ownership of your recordings or transcripts.
13. Responsibility and liability
We do not exclude liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of mandatory consumer rights.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for losses caused by your failure to review transcription output, obtain recording consent, protect credentials, maintain backups, meet system requirements, or follow instructions.
If you use AiraNote for business purposes, to the maximum extent permitted by law we exclude indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, or anticipated savings. Our aggregate liability arising from the service will not exceed the fees paid for the affected service during the 12 months before the event giving rise to the claim.
14. Changes to these terms
We may update these terms for legal, security, payment, or product changes. Material changes will be notified reasonably in advance where practical. Changes do not retrospectively remove accrued rights. If you do not accept a material change, you may cancel before it takes effect.
15. Governing law and disputes
These terms are governed by the laws of England and Wales. Consumers keep any mandatory protections and rights to bring proceedings available in the part of the United Kingdom or country where they live. Before starting formal proceedings, please contact support@airanote.com so we can attempt to resolve the issue.
16. General
If a provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer your account or contract without our consent. We may transfer the contract as part of a genuine business reorganisation or sale, provided this does not reduce consumer rights.
These terms and the documents expressly incorporated into them are the agreement about AiraNote. A support reply, advertisement, or informal statement changes the agreement only where an authorised representative expressly confirms the change in writing. Account, checkout, consent, licence, usage, cancellation, support, and security records may be used to establish what service was supplied and when, subject to applicable law and the Privacy Notice.
